Terms of service
Last updated 2026-10-28
These terms cover your use of Notemark, the web app and the Notemark browser extension. By creating an account or using a shared link you agree to them. They are written to be read, not to be impressive.
Who these terms are between
They are between you and the company operating Notemark. If you accept them for an organisation, you confirm you may bind that organisation, and "you" then means the organisation. If you do not agree, do not use the service.
What the service does
Notemark lets you add a web page or design as a canvas, leave pinned comments on it, invite reviewers, and push that feedback to the tools you connect. We change and improve it over time. We will not remove a material part of a paid plan you are on without telling you first.
Accounts and workspaces
You need an account to create a workspace, and you are responsible for what happens under it, including keeping your sign-in secure. A workspace has one owner, who controls billing and can remove members. Guest reviewers you invite by link do not need an account, and anyone holding a share link can see what that link points to, so treat those links as the keys they are.
Plans, prices and billing
Plans are billed per workspace, in advance, monthly or yearly, through Stripe. Paid plans start with a 14-day trial, and we charge the card on file when the trial ends unless you cancel first. Team includes 3 members and adds $5 per month for each member beyond that, counted as you add or remove them. Switching plan or interval takes effect immediately and Stripe prorates the difference. Prices can change, but never inside a period you have already paid for, and we will give you notice before a renewal at a new price.
Failed payments and cancellation
If a payment fails we retry it for about 7 days while your workspace keeps working. If it still has not been paid after that, the workspace is locked: your data is kept, but creating new work stops until the open invoice is paid. You can cancel whenever you like from billing settings, which keeps the plan running until the end of the period you have paid for; we do not refund the remainder of a period. A workspace that stays locked or canceled is scheduled for deletion 90 days later, and we email the owner before that happens.
Your content
Your canvases, comments, uploads and anything else you put into Notemark stay yours. You give us only the permission we need to run the service: to store that content, show it to the people you share it with, and process it to provide features you ask for, such as notifications, integrations and AI summaries. You confirm you have the right to capture and share the pages you add as canvases. You can export or delete your content at any time, and deleting a workspace removes it on the schedule above.
What you may not do
Do not use Notemark to break the law, infringe someone else's rights, or host malicious code. Do not use the proxy or extension to attack a site, bypass an access control, or scrape at a scale that burdens anyone's servers, and only add pages you are allowed to review. Do not resell the service, attempt to defeat plan limits or rate limits, or probe our infrastructure without written permission. We may suspend a workspace that is causing harm, and we will tell the owner why.
Connected services
When you connect Slack, Linear, Jira, Asana, GitHub, GitLab, Notion or ClickUp, you authorise us to read and write the data that integration needs, and that service's own terms govern what it does with it. We also rely on providers such as Stripe for payments, Supabase for the database, Vercel for hosting, Resend for email and Anthropic for AI features. We are not responsible for a third party's outage, pricing or policy change.
Availability and support
We aim to keep Notemark available and we do take backups, but we do not promise uninterrupted service, and we may take it down for maintenance. Support is by email at support@notemark.app; Team workspaces get priority, and Enterprise agreements can add a response commitment in writing. Nothing here is a service-level agreement unless we have signed one with you.
Ending the agreement
You may stop using the service and delete your workspace whenever you want. We may end these terms, with notice, if you break them materially and do not fix it within a reasonable time, or immediately where the breach causes real harm to us or to someone else. When the agreement ends you lose access to the service, and your data follows the deletion schedule above.
Disclaimers and liability
The service is provided as it is, without warranties beyond those the law gives you and does not allow us to exclude. To the extent the law allows, neither side is liable for indirect, incidental or consequential loss, or for lost profits or lost data, and our total liability for any claim is limited to what you paid us for the workspace concerned in the twelve months before the claim. If you are on the Free plan, that figure is nil, so keep your own copies of anything you cannot lose.
Changes to these terms
We update these terms as the service changes. The date at the top always shows the current version. For a change that materially reduces your rights we will tell account owners by email before it takes effect, and continuing to use Notemark after that date means you accept the new version.
Contact and governing law
Questions about these terms go to support@notemark.app, and we answer them in plain language. These terms are governed by the laws of the State of New Jersey, United States, and the courts there have jurisdiction, except that either side may seek an injunction wherever it needs one.
